Sacramento County Public Defender Can Help Reduce Certain Felony Convictions to a Misdemeanor

Sacramento, CA. April 27, 2015 - Proposition 47, approved by voters in November 2014, provides for certain felony convictions to be changed to misdemeanors. The Sacramento County Public Defender's Office has been appointed by the Court to assist with Sacramento County qualified felony convictions.

Who May Apply?

  • Individuals interested in cleaning up their felony record with the following criminal convictions:
  • Simple drug possession
  • Petty theft $950 or less
  • Shoplifting $950 or less
  • Forging/writing a bad check $950 or less
  • Receipt of stolen property $950 or less

How to Apply:

Complete the Public Defender Information Form and mail it to the Sacramento County Public Defender, 700 H Street, Suite 0270, Sacramento, California 95814. Note, the form must be filed by November 4, 2017.

What Happens Next?

The form will be reviewed by the Public Defender staff and a petition will be filed on all eligible convictions. The status of the case can be viewed online at: https://services.saccourt.ca.gov/PublicCaseAccess/Criminal/SearchByCaseNumber
Once the case is reduced to a misdemeanor, it will be changed on the Record of Arrests and Prosecutions (rap sheet) with the California Department of Justice. 

Note: Prop 47 is not applicable to persons with prior convictions for certain homicides, for violent crimes which carried a life sentence and to registered sex offenders. The Proposition was designed to save state and county criminal justice systems millions of dollars annually and direct the savings into school truancy and dropout prevention, mental health and substance abuse treatment, and victim services.
